Terms and Conditions for Ming Global Ltd.

These Terms and Conditions govern the use of the sourcing services provided by Ming Global Ltd. (“we,” “us,” or “our”), company license number 58864640, located at 8/F China Hong Kong Tower, 8-12 Hennessy Rd, Wan Chai, Hong Kong. By using our services, you (“the Client”) agree to be bound by these Terms and Conditions.

2. Service Description

We specialize in sourcing products and providing samples based on the technical specifications provided by our Clients. Our services aim to connect our Clients with products and samples that meet their needs, based on the information given to us.

3. Disclaimer

While we strive to ensure that the products and samples sourced through our services closely match the technical specifications provided by our Clients, we do not guarantee that every detail will be identical. Differences may occur due to various factors such as manufacturer variations, material availability, and production processes.

Specifically, we disclaim all liability for any claims, losses, or damages arising out of or in connection with discrepancies in pantone colors, craftsmanship, detail finishes, and fabric differences between the sourced products or samples and the original technical specifications provided by the Client.

We make every effort to match the product to the specifications, but subtle variations can occur, which are considered acceptable in the industry. It is widely known that multiple sample rounds can be required to achieve a version that matches the Client’s dream scenario. There is also the impact of samples rarely being made from the exact materials that are to be used in bulk production, as factories making the samples can only buy the exact raw material at the time of bulk production.

4. Client Responsibilities

It is the responsibility of the Client to provide accurate and comprehensive technical specifications. The Client acknowledges that any discrepancies between the sourced products or samples and the provided specifications, including but not limited to pantone colors, craftsmanship, detail finishes, and fabric differences, may not be grounds for a claim against Ming Global Ltd.

5. Limitation of Liability

Ming Global Ltd. shall not be liable for any indirect, special, incidental, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, or use, incurred by the Client or any third party, whether in an action in contract or tort, even if we have been advised of the possibility of such damages.

6. Modification of Terms

We reserve the right to modify these Terms and Conditions at any time. Your continued use of our services after any such modifications constitutes your acceptance of the new Terms and Conditions.

7. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of Hong Kong, without regard to its conflict of law provisions.
